Welcome to Earthside Stories!

These terms and conditions outline the rules and regulations for the use of Earthside Stories's Website, located at https://earthsidestories.com.

By accessing this website, we assume you accept these terms and conditions. Do not continue to use Earthside Stories if you do not agree to take all of the terms and conditions stated on this page.

Payment
A $100 non refundable deposit is required to secure your booking. The remaining balance of your session should be paid in full no later than 3 days prior to shoot date. Earthside accepts direct deposit, credit card and cash payments. In the event that payment is not made in full by this deadline, Earthside reserves the right to terminate your contract, retain the initial deposit, and no longer be held liable for providing further services.

Cancellation or reschedule
A written cancellation notice must be sent via email to ash@earthside.com.au. Cancellation or no-show to your shoot hereby forfeits the initial deposit, and you agree to pay the full amount for the service selected should you cancel this portrait photography contract less than 7 days before the shoot.​ You may reschedule your session once if notice is given to ash@earthside.com.au 7 days prior to your agreed session date, should you cancel again, terms as above will apply.

Travel
Earthside will travel to your location (in fact, we encourage it!), but please note that there is a $50 travel fee if you choose a location more than 20km from Sydney.

Liability
If Earthside should be unable to provide the goods and services outlined in your contract for any reason, Earthside agrees to refund any fees paid by the client, minus applicable expenses, and shall have no further liability with regards to this contract. This limitation of liability also applies to any loss or damage to footage, photographs or other materials after the event that is beyond the photographers control. The sole remedy for any actions or claims resulting from Earthside‘s inability to deliver the goods and services discussed shall be limited to a refund of monies paid by Earthside.

Digital Media
Earthside will keep your images available for 60 days at which point your images will be archived for up to 1 year. It is the client‘s sole responsibility to request any desired prints, products, or files within 60 days of your shoot.

Responsibilities
The Client agrees to prevent any other photographers or videographers at the shoot listed in this contract from interfering with Earthside‘s performance of their duties. This includes guests and other amateur photographers or videographers. Earthside will not be held liable for compromised event coverage due to interference from other parties, including interfering traffic in public spaces. Likewise, Earthside is not responsible for degraded coverage due to environmental issues, such as poor event lighting, space, or backdrops.​

Coverage
Earthside will provide the goods and services listed in the agreed portrait photography contract, including coverage for the listed hours at the venues listed. If additional coverage hours are requested on the day of the events, the client agrees to pay Earthside in full for those additional hours at the hourly rate listed in this contract. ​

Earthside agrees to make every effort to provide satisfactory coverage, but cannot make any guarantees as to specific photos, poses, etc during the event.

Image Processing
Earthside will perform colour correction and retouching prior to delivering any images to the client. Earthside is not responsible for the printed copies of images that are purchased outside of our online store.

Unless otherwise stated, Earthside Stories and/or its licensors own the intellectual property rights for all material on Earthside Stories. All intellectual property rights are reserved. You may access this from Earthside Stories for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

• Copy or republish material from Earthside Stories

• Sell, rent, or sub-license material from Earthside Stories

• Reproduce, duplicate or copy material from Earthside Stories

• Redistribute content from Earthside Stories

This Agreement shall begin on the date hereof.

Parts of this website offer users an opportunity to post and exchange opinions and information in certain areas of the website. Earthside Stories does not filter, edit, publish or review Comments before their presence on the website. Comments do not reflect the views and opinions of Earthside Stories, its agents, and/or affiliates. Comments reflect the views and opinions of the person who posts their views and opinions. To the extent permitted by applicable laws, Earthside Stories shall not be liable for the Comments or any liability, damages, or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.

Earthside Stories reserves the right to monitor all Comments and remove any Comments that can be considered inappropriate, offensive, or causes breach of these Terms and Conditions.

You warrant and represent that:

• You are entitled to post the Comments on our website and have all necessary licenses and consents to do so;

• The Comments do not invade any intellectual property right, including without limitation copyright, patent, or trademark of any third party;

• The Comments do not contain any defamatory, libelous, offensive, indecent, or otherwise unlawful material, which is an invasion of privacy.

• The Comments will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.

You hereby grant Earthside Stories a non-exclusive license to use, reproduce, edit and authorize others to use, reproduce and edit any of your Comments in any and all forms, formats, or media.
